Suspect arrested, charged in 2021 Newark shooting

NEWARK — A man has been arrested and charged in a May 2021 shooting of another man that happened outside the suspect’s home, according to authorities and court documents.

The suspect, Terry Franklin, 28 — who police said at one point had fled out of state — has been charged with attempted murder, shooting at an occupied vehicle, and discharge of a firearm with gross negligence.

The shooting happened the evening of May 25, 2021 outside a residence in the 37000 block of Saint Matthew Drive, where Franklin was living at the time, court documents say. Officers responding to a call of gunfire located evidence of a shooting, including damage to several vehicles and at least one residence. But no victims were found at the scene.

About 30 minutes after the shooting, Fremont police responded to a vehicle collision and found the male driver and sole occupant of a Honda Civic had sustained multiple gunshot wounds. He was transported to a hospital, underwent emergency surgery, and has since recovered, police said in a news release.

Newark detectives took over the investigation and determined that the injured man had been involved in an altercation with another person, later identified as Franklin. Police have not said what the dispute was about or if the two men knew each other.

According to court documents, Franklin allegedly began shooting at the other man as he was running away. The other man took cover behind a vehicle and returned fire before driving away in the Honda with Franklin firing more shots at him, the documents say. Franklin fled before officers arrived.

The incident was captured on video surveillance, according to court documents.

An arrest warrant for Franklin was obtained shortly after the incident, but detectives later learned he had fled the state following the shooting. He remained at large until August 13 of this year, when a Bay Area law enforcement agency arrested him in connection with an unrelated incident. Police have not specified the agency or the nature of their investigation.

On September 3, Newark detectives took custody of Franklin and booked him into Santa Rita Jail on the outstanding arrest warrant stemming from the 2021 shooting. According to court documents he is free on $300,000 bail and was scheduled to appear in court Friday morning to enter a plea.

In the news release, Newark Chief Jonathan Arguello emphasized, “Acts of violence have no place in our community. The Newark Police Department remains steadfast in protecting our community members and will pursue those responsible with unwavering determination until they are brought to justice.”
