Man charged in fatal shooting at Hayward homeless encampment

HAYWARD — A man has been charged with murder in the Aug. 22 fatal shooting of another man at a homeless encampment, according to authorities and court documents.

The suspect, Rosario Raul Rodriguez Cazares, 49, is charged in the killing of a 43-year-old man, identified in court documents as Ignacio Berber Zavala.

The shooting happened about 8 p.m. Aug. 22 at the homeless encampment along a railroad right-of-way in the 30000 block of San Antonio Street. Authorities said both men lived at the camp and had been involved in a dispute of some kind.

A witness told police Berber Zavala ran into the camp followed by two men, one later identified as Rodriguez Cazares.

When Berber Zavala slipped and fell, Rodriguez Cazares took a rifle from the other man with him and allegedly fired several shots at Berber Zavala as he got up and ran off, the documents say.

The victim, who was wounded at least once, was able to make it to a nearby business, where police and paramedics were called. He died later at a hospital.

Police were subsequently able to identify Rodriguez Cazares as the suspected shooter and he was arrested Tuesday in Hayward. He was being held without bail at Santa Rita Jail and is scheduled to enter a plea Sept. 18.

The second suspect was being sought. Authorities did not specify what possible charges that person might face.

Police said Friday in a news release about the homicide that they did not release information at the time of the incident “to protect the integrity of the investigation, to preserve the unconventional crime scene, and to prevent the suspect’s flight from justice.”

The killing is the sixth homicide investigated by Hayward police this year.
