OAKLAND — A man has been charged with killing a man he apparently did not know in the San Antonio district last week, according to authorities and court records.
Gilbert Berry, 43, of Oakland, is charged with murder and possession of an assault weapon in the fatal shooting on May 22 of Jacoby Diego Morales, who had addresses in Las Vegas and San Francisco.
The street shooting happened about 11:30 a.m. in the 1300 block of 18th Avenue. Despite being wounded several times, Morales was able to make it around the corner, where he collapsed in front of a business in 1700 block of International Boulevard.
Before he was taken to a hospital, Morales was able to provide a description of the man who shot him and a description of the vehicle he fled in, court records say. Morales died from his wounds at the hospital at around 2 a.m. May 23.
Luckily, another person had gotten the license plate of the getaway vehicle, the court documents say. The shooting was also captured on video surveillance.
The vehicle was determined to belong to Berry, who lived several blocks away in the 1400 block of 25th Avenue.
Police say they have no information to suggest the two men knew each other before the shooting, which they believe was over them both being interested in the same woman who frequented the area.
Police went to Berry’s home and after a standoff he was arrested about 4:45 p.m. the day of the shooting.
Berry was formally charged Tuesday. He is being held without bail at Santa Rita Jail and is scheduled to enter a plea on June 17.
